Defense attorneys for former President Donald Trump believe that the investigation into efforts by Trump and his allies to overturn the results of the Georgia 2020 general election has been tainted by

“We’ve lost 100% confidence in this process. We feel this process has been compromised,” attorney Drew Findling said in an interview with CBS News’s “Face the Nation.”

Findling’s remarks come after special grand jury foreperson Emily Kohrs indicated that the report, which came out on Feb. 16 after a nearly yearlong investigation and remains mostly sealed, contains evidence for indictments for multiple people and that it is “not a short list.”

If Trump is indicted, his lawyers said they would “absolutely fight anything tooth and nail.”

“We absolutely do not believe that our client did anything wrong, and if any indictments are to come down, those are faulty indictments,” said Jennifer Little, another defense attorney for Trump.

If Fulton County District Attorney Fani Willis decides to move forward, several high-profile witnesses — including Mark Meadows, Rudy Giuliani, John Eastman, and Trump himself — could face criminal charges.

Names connected to any potential indictments have not been released to protect the rights of any “defendants.” Kohrs has appeared on several talk shows and given several interviews on the subject, revealing that more than a dozen people have been recommended for indictments. So far, she has not broken any rules relating to what information the judge ruled can or cannot be release, but her revelations about the ongoing case is unconventional.

Kohrs’s media tour could backfire, however, and risk damaging Willis’s ability to bring the witnesses before a jury on criminal charges — something Findling anticipated.

“Are the results of that special purpose grand jury to be crumbled up like a piece of paper and thrown into a waste paper basket?” Findling said. “Our options are, can this district attorney’s office continue to be part of this case? We have to legally research all of these issues.”

Findling also said that Kohrs is not to blame and noted that if anything, her behavior has given Trump’s lawyers an edge.

“This 30-year-old foreperson, to us, has actually provided us a lens and made us aware that every suspicion we had as to this questionable process was, in fact, a reality,” Findling said. “We have no chagrin toward this foreperson. And it looks like they lost perspective over keeping separation between prosecuting attorneys and members of this grand jury.”

Little said he was “surprised” that he was not called during the grand jury’s investigation. Kohrs said in an interview that “Trump was not a battle we picked to fight.”

“It was surprising, and particularly once we heard the reasons why he wasn’t called,” Little said. She referenced an interview Kohrs did with CNN where she said it would have been “exciting” and “cool” to speak to Trump for “60 seconds.”

“They just determined that, given the resources and the other witnesses that they heard of, that they just didn’t need to have any more evidence, at that point,” Little said. “It’s concerning that that was the level of diligence that was shown in this decision.”

Trump’s response to subpoenas in other probes indicates that he may not have appeared before this grand jury even if they did demand his testimony. In November 2022, the House Select Committee investigating the Jan. 6 Capitol riot revealed that Trump failed to cooperate with the subpoena sent nearly a month prior.

Trump lawyers are also set to fight a subpoena from special counsel Jack Smith requesting testimony for Vice President Mike Pence on Trump’s failed efforts to overturn the 2020 election on executive privilege grounds.
