With hours left until President-elect Donald Trump is inaugurated, Biden announced preemptive pardons for Milley, Fauci, and the members and witnesses of the defunct Jan. 6 committee. Meanwhile, none of these recipients have any charges pressed against them.
“If there is anyone who politically prosecuted somebody, it was — it was the Democrats who did this to President Donald Trump. But what I would say is, why do they need a pardon if they didn’t do anything wrong? What did they do?” Malliotakis said Monday on Fox Business’s Mornings with Maria Bartiromo. “And in terms of these pardons, it just seems to me if they don’t do anything wrong why do you need this pardon? Because we were never party that targeted people, our political opposition. That is what Democrats did to President Trump to try to destroy him personally, professionally, and financially.”
“We’ll see how it plays out. I think very telling that they felt they needed to grant this pardon,” Malliotakis said.
Biden cited “ongoing threats and intimidation” in a statement as a reason behind the pardons.
“The issuance of these pardons should not be mistaken as an acknowledgment that any individual engaged in any wrongdoing, nor should acceptance be misconstrued as an admission of guilt for any offense. Our nation owes these public servants a debt of gratitude for their tireless commitment to our country,” Biden said.

Even before these pardons were issued, Biden set a record in presidential pardons, commutations, and clemencies affecting over 4,200 people. Among them was his son, Hunter Biden, whom he pardoned from the federal gun and tax fraud convictions, including those offenses he “may have committed or taken part in” dating back to 2014.
Both Fauci and Milley publicly thanked Biden for their respective pardons.
