A lawyer for Donald Trump says his legal team will not file a motion to dismiss the indictment against the former president at his arraignment in Manhattan on Tuesday.
Joe Tacopina said filing a motion to dismiss or doing any action before they have seen the charges, related to an alleged hush money payment in 2016, would be “showmanship,” while speaking on CNN‘s State of the Union.

“No, we’re not doing anything at the arraignment because that would be showmanship and nothing more because we haven’t even seen the indictment yet. You know, we will take the indictment. We will dissect it. The team will look at every potential issue that we will be able to challenge, and we will challenge and of course, I very much anticipated motion to dismiss coming because there’s no law that fits this.”
The indictment of Trump will be sealed until he appears at an arrangement hearing, which is currently scheduled for Tuesday.
Tacopina also said he has no reason to believe the judge in the case is biased, citing how he has never been before this judge, but says Trump has “a right to have an issue with everything” regarding the case.
“Well, I just said we have to get the indictment, and then we will evaluate every single legal maneuver. I have no issue with this judge whatsoever,” Tacopina said.
He continued, “But my client has a right to have an issue with everything. He’s been politically persecuted. Make no mistake about that, whether you sit on the right or the left or you’re a supporter or a detractor of Donald Trump. This should really bother you. This should really shape the core of what we believe our justice system should be about.”

The indictment comes after prosecutors in New York City had been looking into allegedly falsified business records regarding a $130,000 reimbursement of Trump’s then-lawyer Michael Cohen for paying off porn star Stormy Daniels. The payment was reported as a legal expense in 2016 during Trump’s presidential campaign.
Trump is the first former president to be criminally indicted, which comes as he is running for the Republican nomination for president in the 2024 election.
