A judge ruled Tuesday that NFL player Henry Ruggs's blood alcohol test will be used as evidence in the case against him. He's charged with driving under the influence resulting in death.

A judge ruled Tuesday that NFL player Henry Ruggs’s blood alcohol test will be used as evidence in the case against him. He’s charged with driving under the influence resulting in death.

Ruggs’s lawyers attempted to argue that police did not have probable cause to administer the test to the then-22-year-old wide receiver at the scene of the crash. Police reported that Ruggs demonstrated “signs of impairment” at the time.

Judge Ann Zimmerman of the Las Vegas Justice Court denied the motion because there was “more than sufficient evidence” to issue a warrant for the test.

The results of the blood alcohol test showed that Ruggs’s blood alcohol level reached 0.16%, which is twice Nevada’s legal limit. Ruggs was driving a Chevrolet Corvette at about 156 mph when he collided with a Toyota RAV4. As a result of the crash, the RAV4 burst into flames and was still on fire when authorities arrived at the scene.

Tina Tintor, 23, and her dog Max both died in the crash. A coroner later determined that Tintor burned to death. She suffered inhalation of combustion products and fractures of the nasal bones, right ribs, left forearm, and left hemothorax, among other injuries.

In addition to the DUI resulting in death charge, Ruggs faces felony charges of DUI resulting in substantial bodily harm and two counts of reckless driving resulting in death or substantial bodily injury, as well as a misdemeanor charge for possession of a firearm while under the influence.

Ruggs was released from the Las Vegas Raiders in November and remains on house arrest.
