Indianas Supreme Court announced it will take up a challenge to a block on the state’s abortion ban and will leave the temporary ban in place while it considers the case.

In addition to declining a request to nix the preliminary injunction against the ban, the high court set a hearing in the case for Jan. 12. Indiana approved the ban in August, joining other red states that ramped up restrictions on abortion after the U.S. Supreme court overturned Roe v. Wade.

Last month, a lower court judge blocked enforcement of the state’s abortion ban through a preliminary junction while a lawsuit worked its way through the courts.
