Ivanka Trump is making a case to avoid providing testimony in the fraud civil suit against her father.

Trump’s lawyer, Bennet Moskowitz, filed a motion earlier this week reiterating that she has not been a part of the Trump Organization since 2016. An appeals court has already dismissed Trump from the case — which mostly surrounds Donald Trump, Donald Trump Jr., and Eric Trump’s business dealings — but New York Attorney General Letitia James is still seeking the eldest Trump daughter as a witness.

On top of her lack of involvement in the family business, Ivanka Trump is no longer a New York resident, so any attempt to deliver a subpoena to her is a reach outside James’s jurisdiction, Moskowitz argued.

“The NYAG knows this, which is why it has subpoenaed three corporate entities as an end-run around its failure to pursue Ms. Trump’s deposition when it had the chance,” Moskowitz wrote in the filing.

James is suing Donald Trump for $250 million for allegedly inflating his own net worth to garner more favorable loan terms. His two sons are expected to be called to testify.

Trump has denied any wrongdoing. He came close to a contempt of court charge when he threw his hands up in frustration during this week’s proceedings, prompting Judge Arthur Engoron to instruct him and his lawyers to keep their voices down.

Meanwhile, Trump is running for the 2023 GOP presidential nomination, facing off against opponents such as former Vice President Mike Pence, former South Carolina Gov. Nikki Haley, Gov. Ron DeSantis (R-FL), and others.
