A rioter from the Jan. 6 storming of the Capitol who called for the assassination of Rep. Alexandria Ocasio-Cortez (D-NY) was sentenced to three years in prison on Wednesday.
Garret Miller, a 36-year-old from Texas, was sentenced to 38 months in prison for his actions during and after the Capitol riot and three years of supervised release.

He pleaded guilty to all charges in December 2022, including assaulting a police officer, three counts of interfering with law enforcement during civil disorder, and entering restricted grounds.
He also pleaded guilty to an interstate threat to injure or kidnap when he tweeted “assassinate AOC” following the riot. The tweet was in response to Ocasio-Cortez’s call to impeach then-President Donald Trump.
Miller, who brought a rope, a grappling hook, and a mouth guard with him to Washington on the day of the riot, said his threat against the congresswoman was intended “to be perceived as a serious intent to commit violence against the congresswoman,” according to court documents in his plea agreement.
Miller was arrested two weeks after the riot when he attended President Joe Biden’s inauguration with a shirt reading “I was there, Washington, D.C., January 6, 2021.” He had also been detained twice during the Capitol riot and was “at the forefront of every barrier overturned, police line overrun, and entryway breached within his proximity that day,” prosecutors claimed.

The Justice Department has been working on cases connected to the riot, in which a mob of Trump supporters descended on the Capitol building to stop the certification of the results of the 2020 presidential election, for over two years.
Altogether the department has handled nearly 1,000 cases connected to Jan. 6, and about 319 of the rioters have been charged with “assaulting or impeding law enforcement,” according to a release from the Justice Department.
