NASCAR driver Kyle Busch is apologizing after being arrested on charges of having a handgun in his luggage while on vacation in Mexico.

Busch took to social media on Monday to detail what happened.

“In late January, Samantha and I enjoyed a several day vacation in Mexico. When departing the country, my handgun was flagged during routine screening at the airport,” Busch wrote.

Busch said he has a valid concealed carry permit but “made a mistake” by forgetting it was in his bag.

“When it was discovered, I fully cooperated with authorities, accepted the penalties and returned to North Carolina,” Busch wrote.

According to the Public Ministry of the Attorney General of the Republic in Quintana Roo, Busch was fined 20,748 pesos, or $1,086, and was sentenced to serve three and a half years in prison.

However, it appears Busch will not serve jail time.

“I apologize for my mistake and appreciate the respect shown by all parties as we resolved the matter. My family and I consider this issue closed,” he wrote.
