A New York man filed a lawsuit against chocolate giant Hershey Wednesday alleging that the company’s dark chocolate has dangerous amounts of cadmium and lead.
According to Christopher Lazazzaro, he would not have purchased specific chocolates produced by Hershey, or at least not paid as much for them, had he known their levels of metal.

These include Hershey’s Special Dark Mildly Sweet Chocolate, Lily’s Extra Dark Chocolate 70% Cocoa, and Lily’s Extreme Dark Chocolate 85% Cocoa, according to a report.
Lazazzaro filed the suit less than a month following the Consumer Reports report, which revealed measurements of the amount of lead and cadmium in 28 dark chocolate bars.
At least 23 bars had potentially harmful amounts of cadmium, lead, or both, per one ounce of chocolate consumed per day, the report noted.

That is a “serious health risk,” according to Lazazzaro.
Lazazzaro’s suit is seeking a minimum of $5 million of damages, including $500 per transaction in accordance with state law.
