Rudy Giuliani will not appear before the House committee investigating the Jan. 6 Capitol riot this week as expected, according to his attorney.
Robert Costello, Giuliani’s attorney, told CNN his client had been scheduled to have a virtual meeting with the panel Friday, but it was scrapped when the committee rejected a request to allow Giuliani to record the audio and video from the interview.
Costello added that Giuliani was still in talks with the committee. Giuliani recording the interview was “was never an agreed-upon condition,” said Tim Mulvey, a spokesman for the Jan. 6 committee.
“If he refuses to comply, the committee will consider all enforcement options,” added Mulvey, who highlighted Giuliani as a key “witness to the conspiracy to overthrow the government.”

Giuliani, a former mayor of New York who later became former President Donald Trump’s personal lawyer, was issued a subpoena from the committee in January, along with lawyers Jenna Ellis and Sidney Powell and Republican strategist Boris Epshteyn.
Giuliani “publicly promoted claims that the 2020 election was stolen and participated in attempts to disrupt or delay the certification of the election results based on your allegations,” Chairman Bennie Thompson said in a letter to Giuliani about the subpoena.
Other close associates and family members of Trump’s that have been called to appear before the committee include Donald Trump Jr., who talked remotely with the panel Tuesday. Trump Jr.’s fiance, Kimberly Guilfoyle, and his sister, Ivanka Trump, met with the committee in April.
