When a pregnant woman was pulled over for driving in a high-occupancy lane in Texas, she claims to have pointed to her stomach and told the police officer that her unborn child was the second passenger.
Brandy Bottone said she was pulled over while driving on U.S. Highway 75 South in late June, according to the Dallas Morning News. Peeking inside the car, the police officer asked if Bottone had a passenger in the car with her.
“My baby girl is right here. She is a person,” Bottone said, pointing to her 34-week pregnant belly.

According to Texas law, a vehicle “occupied by two or more people or a motorcyclist” may use an HOV lane. Although the state’s penal code recognizes an unborn child as a person, Texas’s transportation code does not.
Bottone recalled telling the officer that she had a living child while referring to the Supreme Court’s overturning of Roe v. Wade, which reversed the ruling that legalized abortion across the United States.
The officer reportedly insisted the passenger must be “outside the body” and gave her a $215 citation.
“This has my blood boiling. How could this be fair? According to the new law, this is a life,” the woman reflected. “I know this may fall on deaf ears, but as a woman, this was shocking.”

The Dallas County Sheriff’s Department declined to comment to the news outlet. Bottone said she plans on fighting the ticket later this month when she appears in court.
