Fences are being erected around the Supreme Court as protests intensify following the leak of a draft opinion indicating Roe v. Wade will soon be overturned.
Crews showed up Wednesday night with “tall, nonscalable fencing,” as a Fox 5 reporter put it, with a smattering of protesters present. The security fence is being put up around the building amid security concerns regarding protesters, Fox News reported earlier in the day.
The draft majority opinion leaked to Politico and published Monday night suggests the Supreme Court, which has a conservative majority, is on the precipice of overturning Roe, a 1973 case whose ruling legalized abortions nationwide.
The opinion is not final, and votes among the justices might change before a ruling is dealt sometime in the coming months. The leak prompted Chief Justice John Roberts to order an investigation by the marshal of the court. In a statement, the court confirmed the draft that was leaked is “authentic” but stressed it does “not represent a decision by the Court.”

Earlier in the evening, it was reported that Justice Samuel Alito, who authored the opinion, scrapped plans to participate in the 5th U.S. Circuit Court of Appeals’s judicial conference, which is slated to begin Thursday. A reason for the cancellation was not given by the high court.
