University of Alabama forward Darius Miles, 21, has been indicted on murder charges following the shooting death of a 23-year-old woman on Jan. 15 that occurred near campus.

University of Alabama forward Darius Miles, 21, has been indicted on murder charges following the shooting death of a 23-year-old woman on Jan. 15 that occurred near campus.

Miles claims he gave the weapon to Michael Davis, 20, who then allegedly used it to kill Jamea Harris, 23, near Tuscaloosa, Alabama. Both Miles and Davis have been charged with capital murder, with Miles accused of “aiding and abetting” Davis, according to Fox News.

“While we are not surprised by the indictment based on the reality that a person accused of a crime is not allowed to present any evidence to a grand jury, we are nonetheless disappointed that the government presented this case to the grand jury as capital murder considering the evidence uncovered during our investigation and the obvious weaknesses in the government’s case brought to light during the preliminary hearing,” said Mary Turner, Miles’s attorney.

The gun used by Davis legally belonged to Miles, who had left it in the backseat of current fellow University of Alabama basketball player Brandon Miller’s car. Officials claim it appeared the shooting resulted from an argument between the suspects and Harris.

Miles was kicked off the basketball team following his arrest on the day of the murder.

Police have said there is nothing they can charge Miller with in this case, and as a result, he has been allowed to still play on the team in the two months that have passed following Harris’s death.

Both Miles and Davis are being held in Tuscaloosa County Jail. They are expected to have separate trials.
