President Joe Biden‘s attorneys are in the middle of negotiating with special counsel Robert Hur over terms to interview Biden.

The two sides have been in talks for about a month, according to NBC News. Hur is investigating Biden’s handling of classified documents, which were located in his office at the Penn Biden Center in Washington and at his home in Wilmington.

Negotiations are continuing, and no deal has been reached. The discussions between Hur’s office and Biden’s lawyers include how, when, and where the interview might take place, as well as the scope of the questions, people familiar with the matter said.

An interview with the person at the center of an investigation typically comes toward the end of the process. Biden’s lawyers are inquiring if a sit-down interview between the president and Hur would include questions beyond his vice presidency, preferring to limit the scope, a source said.

Hur’s investigation is in its eighth month after the documents were discovered at the center in November 2022 and at Biden’s Delaware home in January 2023.

Most of the classified documents stemmed from Biden’s time as vice president under President Barack Obama, while some also pertained to his time as a senator. The exact number of documents discovered in Biden’s possession is unknown.

Biden is not the only one facing classified documents investigations. Former President Donald Trump recently pleaded not guilty to all charges stemming from the investigation into the more than 300 classified documents found in his possession at his home in Mar-a-Lago despite the former president’s counsels affirming all materials had been given back to the federal government.

Trump faces 40 charges, including violating the Espionage Act. His case is being handled by special counsel Jack Smith, who also indicted the president on four charges in a separate investigation into alleged efforts to overturn the 2020 election and the Jan. 6 U.S. Capitol riot.

Documents were also discovered at former Vice President Mike Pence’s home in Indiana, but a special counsel was never appointed, and he was cleared of wrongdoing.
