Apple received a small victory on Wednesday when an appeals court in Washington temporarily paused the ban on selling Apple Watches in the United States.
The court issued the stay on Wednesday, allowing Apple to sell the Series 9 and Ultra 2 watch in the U.S. while the court considers Apple’s motion for a longer pause on the ban during the appeals process. The International Trade Commission filed the initial import ban and will have until Jan. 10 to respond to Apple’s motion.

Apple announced last week that it was pausing the Series 9 and the Ultra 2 sales in anticipation of the ITC ban. The product was initially banned due to a patent dispute between Apple and the medical technology company Masimo over Apple’s implementation of a blood oxygen tracker into the device. The commission ruled in favor of Masimo, leading to the ban.

Apple had hoped that the White House would veto the ban. Katherine Tai, a U.S. trade representative, decided on Tuesday to decline Apple’s request.
Apple and Masimo did not respond to requests for comment from the Washington Examiner.
