Sen. Cory Booker (D-NJ) stated he would not trust the Supreme Court to secure the people’s rights should former President Donald Trump win in November.
Booker specifically criticized judges who were appointed by Trump during his presidency, including Supreme Court Justices Neil Gorsuch, Brett Kavanaugh, and Amy Coney Barrett. The senator said the Supreme Court overturned Roe v. Wade even though “the majority of Americans” supported it.
“The majority of Americans believe that we should have access to IVF,” Booker said in an appearance on CBS’s Late Show with Stephen Colbert. “I do not trust these Trump-appointed judges. The last time, he got in there and packed our courts with extreme right-wing folks. I do not trust them to secure our rights. Congress must act.”
However, Trump came out in support of IVF in February, saying he would “always support” it.
Colbert criticized how the Supreme Court justices were voted into their positions by the U.S. Senate after getting nominated by the president, noting how each state only gets two senators who each get one vote. Because of this, he claimed the senators only represent “a fraction” of voters in their states.
The New Jersey senator contended that while he would not say if there are “design issues” with the Constitution, he would say that the founders of the country implemented a way for people to change the Constitution, citing the 13th, 14th, and 15th amendments.
“And so, Americans have a choice,” Booker said. “We can surrender to cynicism about our federal government and all the ways we see it being antidemocratic, unfair, or unjust, or we can take lessons from our ancestors who never gave up on America.”

Ahead of the 2024 election season, Booker encouraged viewers to stop worrying about the results and instead “turn your worry into work.”
Last week, Booker joined Sens. Tammy Duckworth (D-IL) and Patty Murray (D-WA) to unveil a legislative bill that would establish a right to IVF across the nation. Booker cited the Supreme Court’s decision to overturn Roe v. Wade as a reason to protect IVF.
