Former Hollywood executive Harvey Weinstein was hospitalized to be tested after his New York sexual assault conviction was overturned.

Weinstein’s attorney, Arthur Aidala, told the Associated Press that he was moved to Bellevue Hospital in Manhattan on Friday. The move comes one day after the New York Court of Appeals removed his prior conviction in his rape trial.

“They examined him and sent him to Bellevue,” Aidala said. “It seems like he needs a lot of help, physically. He’s got a lot of problems. He’s getting all kinds of tests. He’s somewhat of a train wreck, health-wise.”

Among Weinstein’s many health troubles are cardiac problems, diabetes, sleep apnea, and eye problems. Aidala complained that the prison system was mistreating his client.

“He was not treated well,” he said. “They refused to give him even a sip of water, no food, no bathroom break. He’s a 72-year-old sickly man.”

Despite this, Aidala maintains that Weinstein is doing well mentally, saying that he is “sharp as a tack. Feet are firmly planted on the ground.”

Weinstein’s conviction was overturned on Thursday after the court ruled 4-3 that the judge had made “egregious errors” in conducting the trial.

“We conclude that the trial court erroneously admitted testimony of uncharged, alleged prior sexual acts against persons other than the complainants of the underlying crimes because that testimony served no material non-propensity purpose,” the majority opinion said.

The court ordered a new trial to be held on the charges. Weinstein’s 2022 rape conviction in Los Angeles, which landed a 16-year prison sentence, was unaffected by the ruling.
